Intermittently will not go into gear Code D365

after starting and moving lever top forward, it will rev up, but will not immediately go into gear, after moving mast up and down, turning steering wheel back and forth and flipping from forward to reverse many times, it will suddenly go into gear and then work fine until it is shut down and restarted
it now is giving a code d 365 almost every time it acts up
Dealer says brake switch and foward/reverse switch, we changed the f/r switch and still the same
any more input would be appreciated

Fact of the week
In 1923, French tennis player René Lacoste was promised a crocodile leather suitcase by his captain if he won his next match.
