Jurors in the United States awarded an injured forklift operator USD13,045,776 in a retrial of a case against forklift manufacturer Raymond Corporation, the Madison St Clair Record reports.
According to Casetext.com, Adelaida Anderson filed a products liability action in July 2019 for the injuries she sustained while operating a forklift designed and manufactured by Raymond Corporation.
The Madison St Clair Record previously reported Anderson was operating a forklift at a warehouse in Effingham in 2017 when she hit a bump and fell out of the forklift, which then ran over her leg, causing injury that required amputation.
District Judge Stephen McGlynn this week presided over the re-trial two years after the original trial ended with a verdict for Raymond.
Last year the previous verdict was overturned because of the exclusion of the testimony of a safety expert.
This week the jurors found the forklift was dangerous when it left Raymond’s control, a situation that caused Anderson’s injury, the news outlet reported.
The jury awarded USD2 million each for disfigurement, loss of normal life, risk of future harm, pain and emotional distress.
They awarded USD870,776 for past medical expenses, USD675,000 for past and future wage loss, and USD1,300,000 for future medical expenses and household services.
They awarded $200,000 to Anderson’s late husband’s estate for loss of consortium and companionship.
