A disgruntled US forklift dealer has secured a refund from Omega Lift Distributors Inc of Bolton, Ontario, Canada after Forkliftaction.com's report of a lawsuit again the manufacturer.

Wise Forklift Inc has received back a deposit of USD10,223.80 from Omega Lift.

Larry L Wise, president, says he took the Omega cheque to his bank on 26 November 2014 and is anticipating certification of the funds this week.

The Dothan dealership for Komatsu, Linde and Master Craft forklifts placed an order on 29 August 2013 for an Omega Lift 4DML-series multidirectional forklift and sent the deposit via wire transfer. Wise Forklift cancelled the order on 18 December 2013 for what it said was Omega's non-compliance with delivery promises.

Wise Forklift had purchased a 2011 Omega unit with 411 hours on it from a wholesaler but learned belatedly that the Wise customer could not use the liquefied petroleum gas (LPG) powertrain.

Greg Pannia, Omega Lift chief executive officer, notes that Wise Forklift had purchased the used forklift in the open market and wanted to retrofit the LPG truck to diesel power.

"We don't normally take in trades," Pannia says. "Even though (Wise) placed an order to convert the LPG truck to diesel, once it was done, they cancelled the order."

The Omega contract contained a 10-day non-cancellation clause, "but it also had a delivery time of five to six weeks from the date of the order," Wise notes.

"I thought it was not worth fighting over, so the money was returned," Pannia says.
