Who is liable?

I have a question concerning liability. If a forklift sold by an authorized dealer in 2022 had a style of propane tank that didn't have a fuel level indicator guage on it, is the manufacturer of the forklift responsible? Or, is the company selling the lift responsible. The daily operating checklist indicates to check the fuel levels amongst other systems prior to operating. Without that guage installed, you cannot perform that check. I appreciate any feedback. Thank you.

Most would probably say that it is the responsibility of the company who own/lease the truck as they have responsibility for ensuring the plant is fit for use on their premises and they should know what they are getting when purchasing a lift truck.

I have worked at various sites here in the UK where LPG trucks do not have a pressure/contents gauge and it comes down to the point of as soon as the engine starts to stutter it is known that the cylinder needs to be exchanged or refilled.
