OSHA 1910.178 Citation/Penalty Statistics

Citation and penalty statistics for OSHA 1910.178 (Powered Industrial Trucks) are available for the period October 2006 through September 2007.

Google: OSHA.GOV. On the OSHA home page under Statistics in the lower right column double click on Inspection Data. On the Statistics and Data index page, double click on Frequently Cited OSHA Standards. On the Frequently Cited OSHA Standards page, double click on Industry Profile for OSHA Standard. On the Industry Profile for an OSHA Standard page, select federal or specific state and type in 1910.178 in the standard box and click on submit. On the Industry Profile for OSHA Standard 1910.178; All sizes double click on the SIC selection so desired. (SIC Division yields the most general establishment data. 4-digit SIC yields the most detailed establishment data.)

If my math is correct, the following is a sampling of some of the data:

The State of Washington OSHA state plan issued zero citations for 1910.178 requirements.

The State of North Carolina OSHA state plan issued 464 citations for 1910.178 requirements. 2 citations were without penalty and 462 citations averaged $146.89 in penalty.

The State of Michigan OSHA state plan adopted 1910.178 for Construction Industry only. It issued 13 construction citations for 1910.178 requirements with an average penalty of $161.53.

The State of Virginia OSHA state plan issued 180 citations for 1910.178 requirements. 4 citations were without penalty and 176 citations averaged $478.65 in penalty.

States, Territories, etc. under Federal OSHA jurisdiction issued 3,687 citations for 1910.178 requirements with an average penalty of $672.10. This equates to approximately 108.4 citations per OSHA jurisdiction.

It is obvious that the OSHA enforcement agencies do not consider the 1910.178 requirements as serious violations. It is most likely because they do not understand the true health and safety hazards of powered industrial trucks, especially forklifts.
