Omega Lift Distributors Inc has hired its third set of attorneys and empowered them to seek a settlement with LoneStar Forklift Inc of Garland, Texas.

LoneStar sued Omega Lift, Greg Pannia, Cathy Visco and Shaun Casement in 2013, alleging fraud and misrepresentation. The case is pending before Judge Jorge A Solis in the US District Court in Dallas.

"My hope is that it gets resolved with a reasonable solution," says Pannia, president and chief executive officer of Omega Lift in Bolton, Ontario, Canada.

On 10 November, the judge ordered the defendants to obtain new legal counsel within 30 days, saying, "Once new counsel is retained, the parties are directed to file within 15 days a joint proposed scheduling order." The court vacated a previous scheduling order that could have resulted in a jury trial in April 2015.

LoneStar says Omega Lift refused to refund USD101,000 or deliver an arm telescopic forklift model ARM 10T55-E as promised. During 2013, LoneStar placed the order and a deposit in February and paid the balance in June.
