JLG RESTATES FINANCIALS FOR INCORRECTLY BOOKED
TRANSACTION McCONNELLSBURG, PA, United
States JLG Industries has restated its audited
financial statements for the fiscal year ended July 31,
2003, and may restate its unaudited financial statements
for the first quarter ended October 31.
JLG said
it had prematurely recognised a transaction with USD8.7
million in net revenues, USD1.8 million in net profit
and USD0.04 per diluted share for the year and for the
fourth quarter ended July 31. The restatement reduces
sales and profit in the fourth quarter and will result
in an equal or greater increase in revenue and profit
over the first three quarters of this fiscal
year.
Reported results for fiscal year 2003
included revenues of USD759.8 million, net income of
USD14.2 million and earnings per diluted share of
USD0.33.
The transaction, with a single customer,
was originally recorded in July. JLG re-examined the
terms and subsequent history and concluded the
transaction was incorrectly reported as a sale, rather
than a consignment sale. Under generally accepted
accounting principles, a contingent sale allows
recognition of the revenues only upon final sale of the
equipment by the consignee. As of February, all the
equipment had now been sold, the majority in the fiscal
2004 second quarter, JLG said.
Management said it
notified the audit committee of the board of directors
and JLGs independent auditor, Ernst & Young LLP.
Ernst & Young said the improper accounting
of the transaction reflected a material weakness in
internal controls. JLG has begun an internal review to
determine the circumstances of the transaction, to rule
out or identify any similar transactions within the
current year and the preceding three years and evaluate
and recommend appropriate remedial action.

**FORK TALK** IWLA, OSHA JOIN FORCES FOR
SAFETY WASHINGTON, DC, United States The
Occupational Safety & Health Administration (OSHA)
and the International Warehouse Logistics Association
(IWLA) have joined forces to provide information,
guidance and training resources to the warehousing
industry.
Under a two-year agreement, the two
organisations aim to improve worker safety and health in
forklift operations, materials handling, hazard
communication and chemical safety.
"The alliance
will enhance the safety and health of thousands of
workers employed in the warehouse logistics industry,"
said OSHA administrator John Henshaw. "Together with the
IWLA, we'll be able to provide valuable information and
training resources on issues directly related to the
warehouse industry."
IWLA president Joel Hoiland
said: "I'm pleased to enter into this important alliance
on behalf of the more than 500 warehouse and logistics
companies IWLA represents. IWLA has always recognised
the importance of safer workplaces, devoting a great
deal of time and resources to educating our members in
this regard. Working in conjunction with OSHA, we hope
to expand these efforts."
Particular attention
would be paid to increasing young workers' access to
training resources and safety and health information,
including development of materials written in Spanish,
with the help of community organisations, Mr Hoiland and
Mr Henshaw said.
OSHA and IWLA would develop
tools, including a safety and health inspection
checklist for warehouse managers, and work together to
develop a web-based training tool ("e-Tool") for the
industry.

FORKLIFT RENTAL SCAM EXPOSED DARLINGTON, United Kingdom Forklifts
worth GBP100,000 (USD190,500) have been stolen in a bold
new rental scam sweeping the northeast of
England.
Thieves used legitimate business names
to place orders with three equipment hire firms this
month and steal five forklifts, according to Newsquest
Digital Media.
The first theft was on February 2,
when crooks claiming to be from a firm called Stoneyvale
asked Alliance Material Handling to deliver a forklift
to a Darlington industrial estate. The company delivered
a GBP20,000 (USD38,000) Artisan forklift, but both the
machine and the business had disappeared when the
company went back to collect it.
In the second
incident, B&S Rentals lost two forklifts, worth
GBP40,000 (USD76,180), after they were delivered to
World Solutions in Albert Hill Industrial Estate,
Darlington, on February 6.
Detective Constable
Hannah Bell said a similar incident in Stockton on
February 5 saw another firm lose two forklifts worth
GBP40,000 (USD76,180) also to a company called World
Solutions.
But one firm foiled a possible fourth
theft when a man claiming to be from Worcester-based
firm I Export tried to hire two vehicles, worth
GBP40,000 (USD76,180). When the company insisted on a
deposit and contract with I Export before the forklifts
could be hired, the customer failed to show up to sign
the paperwork.
Det Con Bell said the people
involved used the names of real businesses, but were not
their representatives.
"All hire companies need
to be vigilant when receiving new business, verify that
they are legitimate companies and ensure they have
signed contracts and paid deposits before any goods are
delivered," she said.

COPLIFTER CHARGED AYRSHIRE, United Kingdom A man about
to be served a warrant by police attacked a sheriff's
officer by lifting up his car with a forklift. Ayr
Sheriff Court heard this week that Bernard Rooney, 46,
charged at the officer while driving a forklift on
February 5, according to the Scottish Daily
Record. The charges allege he also raised the car in
the air and pushed it backwards while the stunned
officer was trapped inside. Mr Rooney faces another
charge that he recklessly, with criminal disregard for
the consequences, drove the forklift to endanger the
officer. He is also accused of acting in a disorderly
manner, shouting and swearing, and committing a breach
of the peace at the same time as the alleged
